Criminal Court, with the Honorable Daniel R. King presiding: Justin E. Branagan, 30, of Lowville, entered a GUILTY plea to a charge of fifth-degree Criminal Possession of a Controlled Substance, a class "D" felony, which satisfied all counts he was facing. Sentencing in the case was adjourned until January 5th, when Mr. Branagan will be sentenced as a second-felony offender. Mr. Branagan was accused of possessing a drug with the intent to sell on December 16, 2016 in the Village of Lowville. The plea also satisfies a charge of first-degree Promoting Prison Contraband which he was charged with on October 18th. Daniel J. Haile, 25, of Port Leyden, entered GUILTY pleas to charges of fourth-degree Criminal Mischief, a class "A" misdemeanor and Resisting Arrest, also a class "A" misdemeanor. Sentencing was set for January 19th. Mr. Haile was accused of damaging a wall, sheet rock and a door in the Village of Port Leyden on August 22nd and resisting when officers tried placing him under arrest. Kyle M. Longamore, 21, of Ava, pleaded GUILTY to a charge of fourth- degree Grand Larceny, a class "E" felony. The case was adjourned to January 26th for sentencing. Mr. Longamore was accused of stealing two laptop computers and an Apple TV, valued at $2,133 from the Lowville Walmart on June 22, 2016 with another individual. Matthew D. Ludwikowski, 21, of Port Leyden, was arraigned on charges of third-degree Rape, a class "E" felony, and Endangering the Welfare of a Child, a class "A" misdemeanor. He entered NOT GUILTY pleas to both counts and a trial motions were scheduled, with a final pretrial conference set for February 9th. Mr. Ludwikowski is accused of having sexual intercourse with a person less than seventeen years old on April 12, 2017 in the Village of Lowville. Deanna J. Miller, 50, of Webster, was sentenced to serve a three year probation term on a charge of fifth-degree Conspiracy, a class "A" misdemeanor, to which she entered a guilty plea on September 22nd. She was additionally ordered to pay $250 in court fees. Ms. Miller was accused of conspiring to sell pills in the Town of Martinsburg between February 28 and April 07, 2017. Steven J. Rook, 51, of Greig, was arraigned and entered NOT GUILTY pleas to charges of felony DWI, Reckless Driving, Speeding (93 MPH), and Interfering With Safe Operation for which he was indicted by a grand jury. Trial motion dates were set, with a final pretrial conference scheduled for February 9th. Patricia A. Turck, 37, of Lowville, was sentenced on to serve a three year probation term and perform 50 hours of community service on an ammended charge of second-degree Criminal Possession of Meth Making Materials, a class "A" misdemeanor. She had originally pleaded guilty on July 14th to a charge of Unlawful Manufacture of Methamphetamine, a class "D" felony, but Judge King allowed the charge to be amended after a positive pre plea report. She was additionally ordered to pay $250 in court fees. Ms. Turck was accused of being in possession of meth making materials during a traffic stop on February 18th in the Village of Lowville. |
