    Lowville- The Village Board of Trustees unanimously voted, with the exception
    of Franz Philippe, who was not present, to amend Chapter 77 of the Village Code
    of the Village of Lowville, regarding domesticated animals, at it's regular monthly
    meeting on Wednesday night. The vote was preceded by a public comment
    period.

    The board found that the raising of livestock and domesticated animals in the
    village that would normally be associated with a farm or hobby farm can cause
    problems due to the density of population. The purpose of the amended law is to
    provide certain zoning restrictions on the owning or harboring of such animals
    within the village limits.

    Under the amended law, domesticated animals are defined to include, but not
    limited to, horses, ponies, donkeys, mules, cows, llamas, alpacas, pigs, goats,
    sheep, and poultry including geese, ducks, chickens, roosters, turkeys, pigeons
    or any flocks of the same. The definition does NOT include dogs and cats.

    Domesticated animals, as described above, may be kept in the Village of Lowville
    as an accessory use for personal use and entertainment only when the following
    conditions are met:
    A. Kept fenced or penned in at all times.

    B. That the fences or penned in areas be setback at least fifteen (15) feet
    from all property lines and no closer to the road than the rear line of the
    residence.

    C. All animal waste must be properly disposed of off site and be kept away
    from all property and street lines. Disposal of waste off site should be no
    less frequent than weekly.

    D. No crowing animals such as roosters shall be allowed within the village
    limits.

    E. Odors of animals shall be controlled as to not be noticeable from any
    roadway, sidewalk or neighboring property.

    F. Animals are to be kept from making excessive noise so that the noise
    level at the property line does not exceed more than 5 decibels over
    ambient noise levels.

    G. There shall be no more than 10 poultry on a lot. For all other
    domesticated animals, there must be three (3) acres of property per animal.

    It is important to note that any person owning domesticated animals prior to the
    amended law will be permitted to continue their existing use. If such use is
    discontinued for a period of twelve consecutive months it may not be reinstituted
    expect for in compliance with the amended law.

    Penalties for being found guilty in court of violating the law will be a minimum fine
    of $50 up to a maximum of $250 for a first violation, and a minimum fine of $100
    up to a maximum of $250 for any additional violations within a one year period.
    Each week a violation continues will be considered a new offense.

    The complete amendment can be found below, with the only change being the
    board amended the location of penned or fenced in areas from the listed 50 feet
    of all property lines to within 15 feet of all property lines.
